FOR THE
"2008 Miss Supercross Contest"
THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN CALIFORNIA, ARIZONA, WASHINGTON,
MICHIGAN, INDIANA, TEXAS, MISSOURI, AND GEORGIA AND SHALL ONLY BE CONSTRUED AND
EVALUATED ACCORDING TO UNITED STATES LAW AND IS VOID WHERE PROHIBITED BY LAW.
DO NOT ENTER THIS CONTEST IF YOU ARE NOT A RESIDENT OF ONE OF THE STATES LISTED
IN THE PRIOR SENTENCE. NO PURCHASE IS NECESSARY. MAKING A PURCHASE WILL NOT IMPROVE
YOUR ODDS OF WINNING. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE OFFICIAL
RULES. Contest Name: 2008 Miss Supercross Contest (the "Contest").
Live Nation Motor Sports, Inc., its subsidiaries and affiliated companies ("Sponsor"),
will conduct the Contest substantially as described in these rules, and by participating,
each Entrant agrees as follows:
1. ENTRY PERIOD:
Contest Dates: Beginning 12:01 a.m. Eastern Standard Time (EST) on the the 27th
day of December, 2006 and ending for each Supercross Event on the following dates
(the "Contest End Date"):

2. METHOD OF
ENTRY:
NO PURCHASE BY ENTRANT IS NECESSARY. PURCHASE BY ENTRANT DOES NOT INCREASE ODDS
OF WINNING. Void where prohibited. Deadline for registration is the date stated
in Paragraph 1 above for each respective Supercross Event.
Contest Entrants ("Entrants") can register by logging on to the www.supercrossonline.com
contest website. Find the graphic or text link promoting the Contest and click
on that link. The link will allow you to access the section of the Web Site
containing a description of the Contest and the official entry form. Complete
the entry form by (i) attaching a photograph of yourself (headshot and/or full
body), and (ii) entering your first and last name, age, mailing address (no
post office boxes), e-mail address, and daytime telephone number. After completing
the entry form, click on the "Submit" button. You must complete the
entry form with all required information, for the entry to be eligible. Entrants
must be the registered subscriber of the e-mail account from which the entry
is made. Only one entry per person or household sharing the same e-mail address
will be entered into the Contest. Multiple entries from the same person or household
may result in automatic disqualification. All entries become the property of
Sponsor, and no entries will be acknowledged or returned.
A winning Entrant from each Supercross Event (13 winners in total) will be chosen
by a random drawing to be held on the drawing dates set forth above by the Sponsor
as Winner(s) ("First Round Winners") of the First Round of the Contest.
An online election by members of the public will be conducted (from March 1,
2007 to March 31, 2007) among the First Round Winner. The voting public will
be provided pictures as well as biographies of the First Round Winners and will
be instructed to choose the best Miss Supercross 2008 based on such photographs
and biographies. The top 3 First Round Winners who receive the most votes (the
"Second Round Winners") will receive an invitation to the Las Vegas,
Nevada Supercross Event on May 6, 2007. The Grand Prize Winner will be chosen
from among the Second Round Winners by attendees at the May 6, 2007, Las Vegas
Supercross Event who cast ballots for Miss Supercross 2008. First Round Winners
will be chosen on or about the dates as set forth in the schedule ablve. Second
Round Winners will be chosen on or about March 31, 2007. Second Round Winners
will be notified on or about April 2, 2007 and given seven (7) days from date
of notification to sign and return an affidavit of eligibility and liability
release (and, where permitted, a publicity release) or prize will be forfeited
and awarded to an alternate winner. Grand Prize Winner will be chosen on or
about May 6, 2007. Grand Prize winner will be notified on or about May 6, 2007
and given seven (7) days from date of notification to sign and return an affidavit
of eligibility and liability release (and, where permitted, a publicity release)
or prize will be forfeited and awarded to an alternate winner. Odds of winning
depend on the number of eligible entries received.
3. PRIZE(S):
First Round Prize: Thirteen (13) Winners will receive round trip transportation
reimbursement to the Event for which the Winner was chosen and two (2) passes
to the Event and an official AMP'D MOBILE World Supercross GP / AMP'D MOBILE
AMA Supercross merchandise package. Some travel restrictions may apply. (Approximate
retail value ("ARV") of each First Round Prize: $440). In addition,
the First Round Winners will be featured on a Live Nation Motor Sports produced
calendar.; Second Round Prize: Three (3) Winners will each receive one (1) round
trip airfare to Las Vegas, Nevada, one (1) pass to the Las Vegas Supercross
Event, and two (2) nights hotel accommodations. Dates of travel are to be as
follows: departing from Winner's originating city on Friday of May 5, 2007 and
returning to Winner's originating city on the Sunday of May 7, 2007. Times of
travel on the aforementioned dates will be left to the limited discretion of
the Winner, and will be based on availability. Some travel restrictions may
apply. (ARV of each Second Round Prize: $1,000. ) The actual retail value of
the Prize will vary based upon the time and date(s) of travel.
Grand Prize: One year as Miss Supercross 2008, commencing December 2007, through
May 2008. Miss Supercross 2008 will receive a per-weekend talent fee of $400,
airfare to each round of the AMP'D MOBILE World Supercross GP / AMP'D MOBILE
AMA Supercross Series (excluding non-CCE promoted events), and hotel accommodations
at each round of the AMP'D MOBILE World Supercross GP / AMP'D MOBILE AMA Supercross
series (excluding non-United States and non-CCE promoted events). Miss Supercross
2008 must execute a contract regarding the performance of duties as "Miss
Supercross 2008". (ARV of Grand Prize: $11,280.)
ARV of all Prizes: $20,000. Prize value may vary depending upon departure location
and time of travel, other restrictions and blackout dates may apply. Lost or
stolen Prizes will not be replaced. Prize(s) do not include any other item or
expense not specifically described in these Official Rules, and all additional
expenses, if any, are the sole responsibility of Winner. All travel-related
expenses not set forth herein, including but not limited to, ground transportation,
meals, gratuities and incidental hotel expenses, are the sole responsibility
of the winner. Prizes may not be transferred or assigned except by the Sponsor.
IN THE CASE OF THE GRAND PRIZE WINNER BECOMING UNAVAILABLE TO SERVE THE FUNCTIONS
RELATED TO BEING MISS SUPERCROSS, THE GRAND PRIZE WILL BE TRANSFERRED TO THE
ENTRANT RECEIVING THE SECOND LARGEST NUMBER OF VOTES AT THE MAY 6, 2007 LAS
VEGAS, NEVADA SUPERCROSS EVENT. Only listed Prizes will be awarded and no substitutions
or cash equivalents or redemption will be made, except that Sponsor reserves
the right, in its sole discretion, to award a Prize of equal or greater financial
value. Prize cannot be used in conjunction with any other promotion or offer.
Winners agree to accept the Prize(s) "as is", and Entrants hereby
acknowledge that Employees of the Sponsor, the Contest's participating sponsors
and their advertising agencies, employees of other radio or television stations
or live event promoters, and members of the immediate family of any such persons
(all the foregoing as they are referred to herein, collectively "Sponsor(s)
and Administrators") have neither made nor are in any manner responsible
or liable for any warranty, representation, or guarantee, express or implied,
in fact or in law, relative to the Prize, including express warranties (if any)
provided exclusively by a Prize supplier that are sent along with the Prize.
Reporting and payment of all applicable federal, state or local taxes, if any,
arising out of, or resulting from, acceptance or use of a Prize are the sole
responsibility of each Winner.
***** COMPANIONS ARE REQUIRED TO PROVIDE THEIR OWN TRANSPORTATION. LIVE NATION
MOTOR SPORTS WILL ONLY PROVIDE TRAVEL ACCOMODATIONS FOR SECOND ROUND PRIZE WINNERS
AND GRAND PRIZE WINNER***** Second Round Prize Winners and the Grand Prize Winner
are responsible for all required travel documents. Second Round Prize Winners
and the Grand Prize winner are responsible for obtaining travel insurance (and
all other forms of insurance) where applicable, at their option, and hereby
acknowledge that the Sponsor has not and will not obtain or provide travel insurance
or any other form of insurance.
Any valuation of the Prize(s) stated above is based on available information
provided to Sponsor(s) and Administrators and the value of any Prize(s) awarded
to a Winner may be reported for tax purposes as required by law. Each Winner
is solely responsible for reporting and paying any and all applicable taxes.
Each Winner must provide Sponsor(s) and Administrators with a valid taxpayer
identification number or social security number before any Prize(s) will be
awarded.
All Entrants understand that travel, whether in civilized or remote areas and
whether by plane, automobile, boat, raft, or other conveyance, or by foot, on
land or water and in the air, contains some inherent element of risk of accident,
illness, injury, loss or death, which may be caused by negligence, forces of
nature, wild animals or other agencies, known or unknown. All Entrants, Second
Round Prize Winners and Grand Prize Winner understand that these risks may be
present before, during and after the trip.
Prizes are non-transferable, not redeemable for cash and not exchangeable for
any other Prize. Winners will be required to sign copies of release and tax
forms in order to receive Prize. If a Winner is disqualified, the Sponsor reserves
the right to determine an alternate Winner or not to award that Winner's Prize,
in its sole discretion.
4. ELIGIBILITY AND LIMITATIONS:
Entrants and Winner(s) if applicable, must be (i) legal U.S. residents of one
of the states specified in the first sentence of these rules and (ii) at least
18 years old as of the date of entry. Winner assumes all liability for use of
the Prize. Only one Winner per household for the Contest will be awarded. Only
one Winner per household within one year of winning any prize in a national
and/or group contest conducted by the Sponsor. Employees of the Sponsor, the
Contest's participating sponsors and their advertising agencies, employees of
other radio or television stations or live event promoters, and members of the
immediate family of any such persons are not eligible to participate and win.
The term "immediate family" includes spouses, siblings, parents, children,
grandparents, and grandchildren, whether as "in laws," or by current
or past marriage(s), remarriage(s), adoption, co-habitation or other family
extension, and any other persons residing at the same household whether or not
related.
With regard to online entries, in the event of a dispute about the identity
of an Entrant, each entry will be declared made by the registered account holder
of the e-mail address submitted at time of entry. The registered account holder
is deemed to be the natural person who is assigned the submitted e-mail address
by the relevant Internet service provider, online access provider or other organization
(e.g., business, educational institution, etc.) that is responsible for assigning
e-mail addresses for the domain associated with the submitted e-mail address.
With respect to any winning entry, the Winner may be required to provide Sponsors
and Administrators with proof that the person is the registered account holder
of the e-mail address associated with the winning entry. By entering the Contest,
Entrants agree to comply with and be bound by these Official Rules and the decisions
of the judges which are final and binding in all respects. Failure to comply
with these Official Rules may result in disqualification from the Contest.
5. TELEPHONE AND DELIVERY DISCLAIMER:
Entrants are restricted to use of ordinary and typical computer equipment and
Internet access. The Sponsor disclaims all liability for the inability of a
Entrant to complete or continue an entry due to equipment malfunction, busy
lines, inadvertent disconnections, acts beyond the Sponsor's control, or otherwise.
The Sponsor disclaims any liability for entries not received or received late
or incomplete due to technical difficulties or transmission errors. The Sponsor
disclaims all liability for any delays, mis-delivery, loss, or failure in the
delivery of any item sent by mail, courier, express, electronic transmission,
or other delivery method. The Sponsor is not responsible for mechanical, technical,
electronic, communications, telephone, computer, hardware or software errors,
malfunctions or failures of any kind, including: failed, incomplete, garbled
or delayed transmission of online entries, traffic congestion on telephone lines,
the Internet or at any website or lost or unavailable network connections which
may limit an online Entrant's ability to participate in the Contest, and any
injury or damage to Entrant's or any other person's computer related to or resulting
from participating in or downloading any information necessary to participate
in the Contest.
6. GENERAL CONDITIONS:
The Second Round Prize Winners and the Grand Prize Winner must be available
for travel on the dates specified or the Prize will be forfeited. The Sponsor
reserves the right to select an alternate Grand Prize Winner, in its sole discretion.
The Contest is void where prohibited by law and is governed by the laws in the
United States. Registration by an Entrant is solely the responsibility of the
Entrant. Only valid entries actually received by the Deadlines for Entry referenced
in paragraph #1 of these Official Rules will be considered for the purpose of
determining a Winner. For purposes of these Official Rules, "receipt"
of entry form occurs when Sponsor's servers receives the form. Any automated
computer receipt (such as one confirming delivery of e-mail) does not constitute
proof of actual receipt by Sponsor of an entry for purposes of these Official
Rules. Illegible, unintelligible, incomplete or garbled entries will be disqualified.
Sponsors and Administrators are not responsible for destroyed, delayed, lost,
late, incomplete, mutilated, damaged, stolen, misdirected, illegible entries
or postage due mail or other entries not received by deadline for whatever reason.
Entry materials/data that have been tampered with or altered are void.
Sponsors and Administrators are not responsible for production, typographical
or other errors in the Contest site or these Official Rules. Sponsors and Administrators
are not responsible for mechanical, technical, electronic, communications, telephone,
computer, hardware or software malfunctions or failures of any kind, including:
failed, incomplete, garbled or delayed transmission of online entries, traffic
congestion on the Internet or at any web site or lost or unavailable network
connections which may limit an online Entrant's ability to participate in the
Contest, and any injury or damage to Entrant's or any other person's computer
related to or resulting from participating in or downloading any information
necessary to participate in the Contest. Sponsors and Administrators are not
responsible for incorrect or inaccurate input, transfer or transcription of
entry information.
In the event that technical or other circumstances compromise the Contest (such
as any viruses, bugs, unauthorized intervention, fraud, technical failures or
other causes that corrupt the administration, security, integrity or proper
conduct of the Contest), Sponsors and Administrators reserve the right to cancel,
modify, terminate or suspend the Contest and select Winners from all eligible
entries received prior to the date of termination. If the Contest is cancelled,
modified, suspended or terminated, notice will be posted on the Web Site.
7. RELEASE:
By entering the Contest, Entrant releases and agrees to hold harmless Sponsor,
Administrators, and their respective affiliates and subsidiaries and directors,
officers, employees and agents of each, from any and all liability for injuries
(including bodily injury), losses or damages of any kind resulting from participation
in the Contest and the receipt of or use or misuse of any Prize or component
thereof). ANY PERSON ATTEMPTING TO DEFRAUD SPONSORS AND ADMINISTRATORS OR IN
ANY WAY TAMPER WITH, DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST
WILL BE DISQUALIFIED AND MAY BE SUBJECT TO CIVIL AND/OR CRIMINAL PROSECUTION.
Notwithstanding the foregoing, in the event that the preceding release is determined
by a court of competent jurisdiction to be invalid or void for any reason, the
entrant agrees that, by entering the Contest, (i) any and all disputes, claims,
and causes of action arising out of or in connection with the Contest, or any
prizes awarded, shall be resolved individually without resort to any form of
class action; (ii) any claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with entering the Contest,
but in no event attorney's fees; and (c) under no circumstances will any entrant
be permitted to obtain any award for, and entrant hereby waives all rights to
claim, punitive, incidental or consequential damages and any and all rights
to have damages multiplied or otherwise increased and any other damages, other
than damages for actual out-of-pocket expenses.
8. PUBLICITY:
By participating, where allowed by law, all Entrants and Winner(s) grant the
Sponsor and Administrators exclusive permission to use their names, characters,
photographs, voices, and likenesses in connection with promotion of this and
other contests, including without limitation use on a Miss Supercross calendar,
without further permission and waive any claims to royalty, right, or remuneration
for such use.
9. TAXES:
Any valuation of the Prize(s) stated above is based on available information
provided to the Sponsor, and the value of any Prize awarded to a Winner may
be reported for tax purposes as required by law. Each Winner is solely responsible
for reporting and paying any and all applicable taxes and paying any expenses
associated with any Prize(s) which are not specifically provided for in the
official rules. Each Winner must provide the Sponsor with valid identification
and a valid taxpayer identification number or social security number before
any Prize will be awarded. Prizes are not transferable, redeemable for cash
or exchangeable for any other Prize. Any person winning over $600 in Prizes
from the Sponsor will receive an IRS form 1099 at the end of the calendar year
and a copy of such form will be filed with the IRS.
13. OFFICIAL RULES AND POSTING OF WINNERS' NAMES:
Contest Entrants are hereby authorized to copy these official rules on the condition
that it will be for their personal use and not for any commercial purpose whatsoever.
14. COMPLIANCE WITH LAW:
The conduct of the Contest is governed by the applicable laws of the United
States of America, which take precedence over any rule to the contrary herein.
Sponsor shall follow the applicable laws for conducting contests, including
notice to the state attorney general or consumer affairs office, posting of
a Prize bond, furnishing lists of Winners, and providing specific written information
about the Contest, etc. as required by local and state law.
